नवी दिल्ली: ग्राहकांच्या बिलामध्ये विनापरवानगी किंवा डीफॉल्टनुसार 'सर्विस चार्ज' (Service Charge) जोडणाऱ्या देशातील ४१ रेस्टॉरंट्सविरोधात केंद्रीय ग्राहक संरक्षण प्राधिकरणाने (CCPA) कडक कारवाई सुरू केली आहे. यामध्ये 'चायोस' (Chaayos) आणि 'बार्बेक्यू नेशन' (Barbeque Nation) सारख्या प्रसिद्ध ब्रँड्सचाही समावेश आहे.
राष्ट्रीय ग्राहक हेल्पलाइनवर (NCH) प्राप्त झालेल्या तक्रारींच्या आधारे सीसीपीएने ही कारवाई केली आहे. अनेक रेस्टॉरंट्स ग्राहकांच्या संमतीशिवाय बिलामध्ये परस्पर सर्विस चार्ज जोडत असल्याचे तपासात समोर आले. ग्राहक संरक्षण कायदा, २०१९ नुसार हा एक चुकीचा व्यावसायिक व्यापार प्रकार (Unfair Trade Practice) असल्याचे प्राधिकरणाने स्पष्ट केले आहे. दिल्ली उच्च न्यायालयाच्या २८ मार्च २०२५ च्या निर्णयानुसार सर्विस चार्ज सक्तीचा नसून तो पूर्णपणे ऐच्छिक आहे.
कारवाई आणि नियम काय सांगताहेत?
सीसीपीएने 'चायोस' चालवणाऱ्या सनशाइन टीहाउस प्रायव्हेट लिमिटेड कंपनीवर ५०,०00 रुपयांचा दंड ठोठावला असून ग्राहकाकडून वसूल केलेले पैसे परत करण्याचे निर्देश दिले आहेत.
तसेच सर्व आउटलेट्सवरील सॉफ्टवेअर जनरेटेड बिलिंग सिस्टम बदलण्याचे आदेश देण्यात आले आहेत, जेणेकरून बिलामध्ये आपोआप सर्विस चार्ज जोडला जाणार नाही.
मुख्य नियम: हॉटेल किंवा रेस्टॉरंट्स जेवणाच्या बिलामध्ये डीफॉल्टनुसार सर्विस चार्ज जोडू शकत नाहीत, तो कोणत्याही इतर नावाखाली गोळा करू शकत नाहीत, ग्राहकांना तो देण्यासाठी सक्ती करू शकत नाहीत आणि सर्विस चार्जवर जीएसटी (GST) आकारू शकत नाहीत.
